01. Regulatory Compliance and Jurisdiction
Regulatory compliance. This Privacy Policy is governed by the data protection laws of the State of Mississippi and the State of Florida, depending on which HSO Technology entity (Huron Smith Oil Co Inc, HSO Petroleum Services LLC, or HSO Global LLC) acts as the controller of your personal data. Relevant United States federal laws also apply, including the Children’s Online Privacy Protection Act (COPPA) and the California Consumer Privacy Act (CCPA) where applicable. We also adopt the standards of the European Union’s General Data Protection Regulation (GDPR) for users to whom it applies.
Force majeure. HSO Technology shall not be liable for the loss, unauthorized access, or disclosure of personal data when such events result from force majeure, including sophisticated cyberattacks that overcome our reasonable security measures, natural disasters, fire, flood, acts of terrorism, pandemics, external infrastructure or internet failures, or unforeseen legislative changes, without prejudice to our statutory security breach notification obligations.
Governing law and dispute resolution. Any claim, controversy, or dispute relating to privacy or the processing of personal data shall be interpreted in accordance with the laws of Mississippi for data processed by Huron Smith Oil Co Inc or HSO Petroleum Services LLC, and the laws of Florida for data processed by HSO Global LLC. The parties shall first attempt to resolve the dispute through good‑faith negotiation; if no agreement is reached within thirty (30) days, they shall submit to the competent courts of the corresponding county as set forth in the General Terms and Conditions.
